K.G.M. v. Meta Platforms, Inc.: The Landmark Verdict Redefining Responsibility for Social Media Addiction

A California jury recently delivered a landmark verdict in K.G.M. v. Meta Platforms, Inc., finding Meta Platforms, Inc. (“Meta”) and Alphabet Inc.’s Google LLC (“Google”) negligent for designing products that harmed a young user’s mental health. (Cecilia Kang, Ryan Mac, & Eli Tan, N.Y. Times). The case is especially significant because it was selected as one of three scheduled bellwether trials, a representative test case used in large-scale litigation to help courts and parties evaluate how juries may respond to the core legal and factual issues that appear across thousands of similar lawsuits. K.G.M. was chosen from a pool of more than 1,600 plaintiffs, including over 350 families and 250 school districts, all alleging harm from social media platforms. (Quynh Hoang, The Conversation). As a representative case, the verdict may shape settlement strategy, litigation posture, and the trajectory of similar lawsuits nationwide. This post examines the arguments raised at trial that led to the verdict, considers the issues Meta and Google will likely raise on appeal, and explores how the verdict could reshape liability for social media companies going forward.

At its core, the case turned on whether social media platforms can be held liable for the way they are designed, rather than for the content they host. (The Spencer Law Firm). K.G.M. argued that Meta’s Instagram and Google’s YouTube were deliberately engineered to foster compulsive use among young users. Id. K.G.M.’s arguments focused on product design, suggesting that features such as infinite scrolling, autoplay, push notifications, algorithmic recommendations, and beauty filters were intentionally designed to keep young users engaged in ways that fostered addiction-like behavior. K.G.M. claimed those features contributed to or exacerbated her anxiety, depression, body dysmorphia, and suicidal ideation, while also tying her self-worth to digital validation such as likes and follower counts. In defending similar claims, social media companies have historically relied on Section 230 of the Communications Decency Act, which generally shields online platforms from liability arising out of content posted by users. By framing the platforms as defectively designed products, K.G.M.’s attorneys sought to circumvent that shield and argue that the platforms’ architecture itself was defectively designed. (Quynh Hoang, The Conversation).

At trial, K.G.M.’s counsel repeatedly framed Instagram and YouTube as examples of engineered addiction, likening them to products designed to exploit reward-seeking behavior in young users. (Bobby Allyn, NPR). K.G.M. testified that social media consumed her daily life, affected her sleep, interfered with school, and deepened her mental health struggles. (Hillel Aron, Courthouse News). She described constantly checking the apps, craving validation, and feeling unable to stop. Id. K.G.M. relied heavily on internal company documents to show that employees within Meta and Google were allegedly aware that their products could create compulsive use patterns among young users. One Instagram communication described the company as “basically pushers,” while a YouTube strategy memo stated that if the company wanted to “win big with teens,” it needed to bring them in “as tweens.” (Hillel Aron, Courthouse News).

Meta and Google responded with two central arguments: causation and classification. Id. First, both companies argued that K.G.M.’s mental health struggles were not caused by their platforms, but instead stemmed from a complex mix of personal circumstances, including family instability and abuse. Id. Second, they rejected K.G.M.’s framing of their products as addictive or defectively designed. (Bobby Allyn, NPR). Meta emphasized that social media is not inherently harmful and cannot be reduced to a single cause of psychological distress. Id. Meta CEO Mark Zuckerburg testified that “if people feel like they’re not having a good experience, why would they keep using the product?” Id. Google argued that YouTube is not meaningfully “social media” in the same sense as Instagram and should not be treated as such for liability purposes. (Cecilia Kang, Ryan Mac, & Eli Tan, N.Y. The jury ultimately rejected those defenses. After eight days of deliberations, the jury found that Meta and Google were negligent in the design of their platforms and failed to warn users of associated risks. (Hillel Aron, Courthouse News). The jury awarded $3 million in compensatory damages and an additional $3 million in punitive damages, for a total verdict of $6 million. Id. The jury allocated 70% of responsibility to Meta and 30% to Google, reflecting the larger role Instagram played in K.G.M.’s use history and claims. Id.

Meta and Google have both announced plans to appeal and are expected to challenge the verdict on various grounds. (Dawn Chmielewski, Courtney Rozen, & Jody Godoy, Reuters). A likely issue on appeal will be whether Section 230 extends to platform functions such as recommendation algorithms and content delivery systems, or instead applies only to traditional publishing and moderation of third-party content. Meta and Google will likely argue that K.G.M.’s claims ultimately seek to hold them liable for how third-party content is recommended, organized, and delivered to users, functions they will characterize as protected under Section 230. By contrast, K.G.M.’s arguments will depend on maintaining that the challenged harms arise not from third-party content itself, but from the platforms’ own design choices and recommendation architecture. Id. How appellate courts draw that distinction will shape the future scope of platform immunity.

Beyond Section 230, Meta and Google may also challenge whether the evidence was sufficient to prove that the platforms’ design features were a substantial factor in causing K.G.M.’s injuries. Throughout broader social media addiction litigation, companies have repeatedly argued that the evidence did not reliably establish that platform use or specific design features caused the mental health harms alleged by plaintiffs. (Jeff Horwitz, Reuters). On appeal, Meta and Google may therefore contend that the verdict rested on causal inferences too attenuated to support liability. Id. How appellate courts confront these issues may ultimately determine whether traditional products liability can be extended to address the unique harms caused by modern digital design.  

Regardless of how any appeals unfold, the verdict in K.G.M. v. Meta Platforms, Inc. already signals a meaningful shift in how courts and juries may evaluate social media platforms. At a minimum, it demonstrates that design-based liability theories can not only survive long enough to reach a jury, but can also prevail. (Dana Kerr, The Guardian). That shift is already underway, with multiple related lawsuits poised to proceed to trial. A separate social media addiction case brought by several states and school districts is expected to go to trial this summer in federal court in Oakland, while another California state bellwether trial involving Instagram, YouTube, TikTok, and Snapchat is slated to begin in Los Angeles in July. (Education Week; The Spencer Law Firm).  Further, a New Mexico jury recently found Meta liable in a separate suit alleging that the company made misleading statements about the safety of its platforms and enabled child sexual exploitation on Facebook, Instagram, and WhatsApp. (Morgan Lee, AP News). Taken together, these cases suggest that future litigation may extend beyond social media addiction and into claims involving child safety, harmful content amplification, and other foreseeable risks tied to platform design. In that sense, K.G.M. v. Meta Platforms, Inc. may mark the moment courts stop treating platforms as passive hosts of content and begin asking whether the product itself is the harm.
